Background Information and Documents
Allied Homes & Development submitted an application to subdivide 23.42 acres into a 100-lot residential subdivision. The 100 proposed lots vary in size from 7,500 to 8,659 square feet.
The Planning Commission approved the application with conditions. Several citizens appealed the Planning Commission decision on February 26, 2020.
On March 2, the City Council decided to hear the appeal “de novo” which will allow for the introduction of additional evidence and testimony by any party. In accordance with Sandy Municipal Code 17.28.50(B), the record associated with the Planning Commission’s decision will be presented to the Council as part of the appeal, but the Council may consider additional evidence and testimony and will conduct an independent review of the proposed subdivision.
The City Council conducted a public hearing for the appeal on April 6. During its deliberations at its meeting on April 20, a majority of the City Council indicated its view that the Bailey Meadows application should be denied. Given the particular type of application at issue, pursuant to ORS 197.522, the applicant had one additional opportunity to amend the proposal. The amended proposal was made public and additional public comment was accepted on the changes only. See the schedule below:
- April 28th at 5:00 PM - Deadline for the Applicant to submit proposed changes to the land use application or proposed condition changes. Proposal will be made public on the City of Sandy website.
- May 4th at 5:00 PM - Public comment deadline. Comments must be limited to the proposed changes only. Please submit comments by email to recorder@ci.sandy.or.us
- May 6th at 5:00 PM - Final written argument from the Applicant deadline.
- May 13th - Staff report regarding revised application or revised conditions will be available on the City of Sandy website.
- May 18th - City Council will review the proposal from the applicant, the additional public comments, and the staff report, at a public council meeting.
- May 26th - Revised 120-day deadline to issue final ord
Additional Proposed Condition of Approval: Pursuant to ORS 197.522, the Applicant has proposed an additional condition of approval for the Council to consider at its meeting on May 18th. The proposal makes reference to Exhibit W, which is available in the exhibit list below.
