What is a Conditional Use?
A Conditional Use is a use that would generally not be appropriate within a particular area but, if controlled, would not be detrimental to the public health, safety, and welfare of that area. Conditional Use requests require notification to adjoining property owners and are reviewed by the Planning Commission. For new development, uses required to obtain Conditional Use approval also typically require design review.

Where can I find Conditional Use review criteria?
Conditional Use review criteria are found in Chapter 17.68, Conditional Uses, of the Development Code. An application for a Conditional Use permit requires the applicant to submit evidence substantiating that all requirements of the Development Code relative to the proposed use are satisfied and consistent with the purposes of Chapter 17, policies of the Comprehensive Plan, and any other applicable policies and standards adopted by the City Council.
How does the Conditional Use permit process work?
The process for submittal of a Conditional Use permit is similar to other land use applications. A Land Use Application is submitted with required materials. Staff prepares a staff report and the application is reviewed by the Planning Commission, who issues a Final Order and decision. Once the conditional use permit process is complete and conditions are satisfied the land owner or developer can then apply for building permits and/or a business license.
